Welcome to Avenija. These Terms and Conditions govern your use of our online platform, available at avenija.mk, where users can list properties, list companies, and collaborate with members of their organization.

By accessing or using our website and services, you agree to be legally bound by these Terms and to comply with all applicable laws of the Republic of North Macedonia.

Acceptance of terms

By using the platform, registering for an account, listing properties, or managing a company, you agree to these Terms. If you do not accept them, please do not use the platform.

These Terms apply to all users, including individuals, agents, agencies and companies that list properties or manage the company.

Eligibility

To use our services, you must:

  • Be at least 18 years old or at least 16 years old with verifiable consent from a parent or legal guardian;
  • Have the legal capacity to enter into binding contracts under the laws of North Macedonia;
  • Use the platform in accordance with these Terms and applicable national legislation.

Account registration

To access certain features, you must create a user account. You agree to:

  • Provide accurate and up-to-date information;
  • Keep your login credentials confidential;
  • Be responsible for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

Properties

Users may create and manage properties through their individual or company accounts.

By submitting a property, you confirm that:

  • You are authorized to list the property (as owner, agent, or representative);
  • All property details are accurate, lawful, and not misleading;
  • The content complies with all laws and regulations in North Macedonia, including the Law on Trade, the Law on Obligations, and the Law on Protection of Consumers.

We reserve the right to remove or edit any property that violates these Terms or appears to be false, misleading, or unlawful.

Companies

You may create a company and invite other registered users as members of your company. As a company owner or admin, you are responsible for:

  • Managing user access, roles, and permissions;
  • Ensuring that all members comply with these Terms;
  • Monitoring and approving content submitted by your team.

We are not liable for actions or omissions by company members under your account.

Prohibited activities

You agree not to:

  • Post fraudulent, misleading, or illegal information;
  • Upload or transmit malicious software, spam, or harmful content;
  • Use automated systems (bots, scrapers) to extract data from the platform;
  • Violate intellectual property rights or personal privacy laws;
  • Use the platform for purposes contrary to the public interest or good practices.

Violations may result in immediate suspension or legal action.

Intellectual property

All content and technology on the platform, except user-generated content, are owned by or licensed to us. This includes, but is not limited to, design, software, logos, and trademarks.

By submitting content (e.g., properties, images, company details), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for purposes related to the platform’s operation.

Limitation of liability

To the maximum extent permitted by law, we are not liable for:

  • Errors, inaccuracies, or omissions in listings;
  • Loss of data or content;
  • Business losses or missed opportunities;
  • Any disputes between users, agents, or companies.

Our liability, if any, shall be limited to the amount you paid (if any) to use the platform in the past 12 months.

Disclaimer of warranties

We provide the platform "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee:

  • Continuous or error-free operation;
  • Accuracy or completeness of properties and companies;
  • That the platform will meet your expectations or objectives.

Use of the platform is at your own risk.

Termination

We reserve the right to suspend or permanently terminate your account if:

  • You breach these Terms;
  • You misuse the platform;
  • Required by law or competent authority.

Upon termination, all content associated with your account may be deleted.

Data protection and privacy

We collect and process your personal data in accordance with the Law on Personal Data Protection of North Macedonia. Please refer to our Privacy Policy for more details on how your data is used, stored, and protected.

Governing law and dispute resolution

These Terms are governed by the laws of the Republic of North Macedonia.

Any disputes arising from or relating to these Terms shall be resolved:

  • Primarily through amicable negotiation;
  • If unresolved, before the competent courts in Skopje, unless otherwise agreed.

Changes to the Terms

We may update these Terms from time to time. Significant changes will be communicated via the platform or email. Your continued use of the platform after changes indicates your acceptance.
